Who would the SEC sue? (serious)

The SEC Chairman has been making a lot of noise lately by suggesting that ETH could be a "security" due to its transition to PoS. This misguidance is unfortunate but if the SEC decided to bring action against "Ethereum" who would they go after? There is no one company who owns or manages Ethereum so any thoughts on how this would play out?
